Terms of Service

TradeReply ("we", "us", "our") provides an AI-powered lead follow-up, SMS communication, appointment booking, invoicing, and reactivation platform for home-service businesses. By creating an account or using our services, you ("you", "user") agree to these Terms.

You are responsible for the accuracy of the information you provide, for complying with all applicable laws (including telemarketing and consumer-protection laws), and for obtaining proper consent before messaging any contact. You are responsible for your business's pricing, invoices, and customer relationships.

TradeReply uses artificial intelligence to draft and send messages on your behalf. AI-generated content may occasionally be inaccurate. You are responsible for reviewing AI communications and may take over any conversation at any time. TradeReply is not liable for AI-generated statements that you authorize to be sent.

TradeReply sends SMS messages through third-party providers (such as ClickSend). You must have the legal right to message each recipient and must honor opt-out requests (STOP). Message and data rates may apply to recipients. You are responsible for obtaining and maintaining SMS consent from your contacts and for complying with the Telephone Consumer Protection Act (TCPA), CTIA guidelines, and carrier requirements. TradeReply is offered on a monthly subscription basis (Starter, Pro, and Business plans). Subscription fees are billed through our payment provider. Each plan includes a monthly SMS allowance; additional SMS beyond the included allowance is billed at the stated per-message rate. Overage is tracked and invoiced separately; we do not auto-charge variable overage to your card unless a metered billing integration is in place. You may cancel at any time; cancellation stops future billing but does not refund the current period.

TradeReply allows you to create and send invoices to your customers and to record payments. You are responsible for the accuracy of your invoices and for collecting payment from your customers. Online card payments to your business require a connected-account payment provider (such as Stripe Connect), which is separate from your TradeReply subscription. TradeReply does not store raw card numbers or CVV.

You will not use TradeReply to send unlawful, harassing, or deceptive messages; to message anyone who has not consented or has opted out; to infringe others' rights; or to misuse the AI to generate harmful content. We may suspend accounts that violate these terms.

TradeReply is provided "as is." SMS delivery depends on third-party carriers and providers and is not guaranteed. AI features may be unavailable or inaccurate. We do not warrant that the service will be uninterrupted or error-free.

TradeReply and its software, branding, and content are our intellectual property. You retain ownership of your business data and customer information. You grant us a limited license to process your data as needed to provide the services.

We may suspend or terminate accounts for non-payment, abuse, or violation of these Terms. You may cancel your account at any time.

You are responsible for all charges incurred under your account. Unpaid subscription fees may result in service suspension. Overage and other invoiced amounts are due per their terms.

The service is provided without warranties of any kind. We do not guarantee specific business results, lead conversion, or revenue.

To the maximum extent permitted by law, TradeReply and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenue, arising from your use of the service. Our aggregate liability is limited to the amount you paid us in the preceding 12 months.

We may update these Terms from time to time. Material changes will be posted on this page. Continued use after changes constitutes acceptance.
